1. Welcome to Booqit

Booqit is an online marketplace connecting brands, creators, and production teams with unique spaces and creative talent across the UAE. We've developed these terms to be clear and fair. Please read carefully, as they govern your use of our platform, including booking and listing spaces, booking talent, and interacting with other users.

2. Important Legal Notice

Binding Arbitration: Except where prohibited by UAE law, this Agreement contains waivers of class actions and an agreement to submit all claims and disputes to binding arbitration. If you do not agree to all terms and conditions of this Agreement, including those governing disputes, you may not use our platform or services.

Governing Law: These terms are governed by the laws of the Emirate of Dubai, UAE. Any disputes shall be resolved through binding arbitration in Dubai.

3. About Booqit

When these terms mention "Booqit," "we," "us," and "our," it refers to Booqit Technologies FZ-LLC, located in Dubai, United Arab Emirates.

4. Platform Overview

Booqit provides a platform to help users connect with each other to book spaces and services. We do not endorse any specific Hosts, Talent, Clients, Spaces, or Services registered with or offered through Booqit. All designations or badges provided through the platform are based on information available to us, which may be inaccurate or out of date. Each user is independent, and Hosts and Talent are independent contractors, unaffiliated with Booqit, solely responsible for the character, quality, utility, and provision of any space or service they provide.

5. Three-Sided Marketplace

Booqit operates a three-sided marketplace:

Hosts: Space owners who list unique venues

Talent: Creative professionals offering services (Photographers, Videographers, Editors, Drone Operators)

Clients: Creators and brands booking spaces and/or talent

Each party is independent and responsible for their own conduct and compliance with applicable laws.

6. Mandatory Platform Use

All payments, communications, and bookings must be processed through the Booqit platform. Attempting to move transactions off-platform to circumvent fees is a serious violation of our policies and will result in immediate account termination.

7. User Accounts

You must create an account to use Booqit. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information updated.

8. Service Fees

Booqit charges the following service fees:

For Space Bookings:

Hosts: 10% service fee on booking price

Guests/Clients: 15% service fee on booking price

Total platform take-rate: 25%

For Talent Bookings:

Talent: 10% service fee on booking price

Clients: 10% service fee on booking price

Total platform take-rate: 20%

All transactions are subject to 5% UAE VAT, calculated on the total booking price including service fees.

9. UAE Compliance Requirements

All users must comply with applicable UAE laws and regulations, including:

DET Holiday Home Registration: Required for all apartments and villas before listing

DFTC Filming Permits: Required for all video/photo production

Noise Regulations: 55dB daytime / 45-50dB nighttime; 10 PM end time for residential events

Alcohol Prohibition: Prohibited at residential space bookings

Cultural Compliance: All content must respect Islamic values and UAE cultural norms

10. Prohibited Activities

The following activities are strictly prohibited on Booqit:

Illegal activities (theft, fraud, violence, drug production, human trafficking)

Sexual exploitation, abuse, or assault

Harassment, discrimination, or hate speech

Weapons (except authorized prop weapons or licensed security)

Misrepresentation or fraud

Off-platform transactions to circumvent fees

Violation of privacy or surveillance without consent

Disturbing neighbors or violating noise regulations

Alcohol at residential space bookings

Filming without required permits

Violation of cultural or religious standards

11. Termination and Suspension

Booqit may suspend or permanently terminate accounts for policy violations, conduct violations, payment fraud, damage or theft, harassment or threats, illegal activities, repeated cancellations, or low ratings. Users may appeal suspensions or terminations through Booqit's support system.

12. Limitation of Liability

Booqit is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Booqit's total liability shall not exceed the amount of fees paid by you to Booqit in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Booqit from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the platform, your violation of these terms, or your violation of any rights of another party.

14. Changes to Terms

Booqit reserves the right to modify these terms at any time. We will notify users of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified terms.
